The petitioners seek bail in connection with Bhabua P.S. Case No. 623 of 2016 registered under Sections 302, 201, 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that altogether seven persons were named in the First Information Report submitted by the informant. The petitioners are neither named in the F.I.R. nor any incriminating materials is against him. Their name surfaced in confessional statement of F.I.R. named accused Rohit Singh who besides the name of these petitioners, disclosed the names of few others. The non-FIR named accused namely, Avinash Pandey, Ajeet Patel and Rana Pratap have been granted regular bail vide order dated 23.02.2017 passed in Cr.

Patna High Court Cr.Misc. No.10034 of 2017 (2) dt.01-03-2017 2/2 Misc. No. 1412 of 2017, 751 of 2017 and 1460 of 2017 respectively. The case of these petitioners stands on similar footing.

Considering the nature of the allegation against the petitioners and the fact that similarly situated co-accused persons are enjoying the privilege of bail, their prayer of bail is allowed. The petitioners, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 623 of 2016.
