The petitioner apprehends his arrest in Sigori P.S. Case No.39 of 2019 registered under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of Bihar Prohibition and Excise Act.

The S.H.O. of Sigori got information about the manufacturing of country made liquor by the side of Punpun river and on such, went there and arrested one person who disclosed his name as Mithilesh Kumar. Mithilesh Kumar disclosed the name of the petitioner(Manoj Kumar) as the person who was assisting him in manufacturing country made liquor.

The learned counsel for the petitioner submits that the petitioner was not arrested on the spot and Mithilesh Kumar, the

Save and except the confession, there is no material against the petitioner. Petitioner has got no criminal antecedent. Taking into consideration the fact that nothing has been recovered from the possession of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, District-Patna in connection with Sigori P.S. Case No.39 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
