The petitioner is in custody in connection with Hajipur Sadar P.S.Case No.269 of 2016 registered for an offence under Section 307 of the IPC and 27 of the Arms Act. The informant in his fardbeyan has stated that on 01.08.2016 when he was unloading materials from the tractors at his shop when three motorcycles borne criminals came and shot fire causing injury on his person.
Counsel for the petitioner submits that this petitioner and one Naresh Kumar @ Naresh Sharma were arrested and they alleged confessed their guilt in the above crime. The co-accused Naresh Kumar @ Naresh Sharma who alleged confessed has been allowed bail by this Court vide order dated 23.02.2017 passed in Cr.Misc.No.53292 of 2016 and the case of this petitioner stands on
Patna High Court Cr.Misc. No.5880 of 2017 (3) dt.12-04-2017 2/2 better footing. Petitioner is in custody since 06.09.2016 However, learned APP opposed the submissions. Considering the nature of allegation and the fact that similarly situated co-accused Naresh Kumar @ Naresh Sharma has already been granted bail by one of the coordinate Bench of this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Vaishali at Hajipur in connection with Hajipur Sadar P.S.Case No.269 of 2016.
