30-04-2015 Heard Mr. Ambika Bhagat, learned counsel for the petitioner and Mr. Satyavrat Verma, learned A.P.P. for the State.

The petitioner apprehends arrest in connection with Muffasil P.S. Case No. 76 of 2014 dated 24.04.2014 instituted under Sections 341/323/337/379/ 325 /307/447/504/34 of the Indian Penal Code. The allegation against the petitioner and other co-accused is that they had assaulted the informant, his wife and other relatives with Iron rod, stick and brick-bats resulting in injuries.

Learned counsel for the petitioner submits that as per the F.I.R. itself, the genesis of the incident is that there was some difference between the children of the two sides in which the adults got involved and at best it was a case of spontaneous scuffle without there being any specific

Learned counsel submits that the petitioner besides being a lady has no criminal antecedent and is only said to be one among 11 persons who took part in the brawl. Learned A.P.P. submits that the petitioner was also member of the party which assaulted the informant and his family members in which five persons have been injured. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Munger in Muffasil P.S. Case No. 76 of 2014, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Ahsanuddin Amanullah, J.) P. Kumar U T
