JUSTICE RAKESH KUMAR ORAL ORDER 18-08-2016 Heard Sri Aditya Narayan Singh, learned counsel, who was assisted by Sri Kundan Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26.04.2016 in Siwan Rail P.S. Case No.12/2016 registered for the offence under Section 47/ 57 of the Bihar Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner has falsely been apprehended on an allegation of bringing about 10 Liters of Indian made foreign liquor and one liter of country-made liquor from other State. He submits that the petitioner is having clean antecedent. Learned Addl. Public Prosecutor has opposed the

Patna High Court Cr.Misc. No.32134 of 2016 (2) dt.18-08-2016 2/2 prayer for bail of the petitioner.

However, keeping in view the nature of accusation and period of custody, let the petitioner, namely, Pappu Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur, Saran in connection with Siwan Rail P.S.
