JUSTICE KUMAR MANISH ORAL ORDER 24-07-2026 Heard learned counsel for the petitioner, Ms. Isha Mishra, learned counsel for the informant, Mr. Karandeep Kumar along with learned A.P.P. for the State, Mr. Umesh Lal Verma.

2. This application is filed for grant of regular bail to the petitioner who has been made accused in connection with Pipra P.S Case No. 71 of 2026 instituted for the offences punishable under Sections 137(2), 96, 3(5) of the B.N.S. 2023.

3. As per the prosecution case, the informant alleged that on 15.02.2026, all the accused persons, including this petitioner under a conspiracy, forcefully took the daughter of the informant, namely, Kumanti Kumari in a four wheeler vehicle

Patna High Court CR. MISC. No.38522 of 2026(3) dt.24-07-2026 2/3 for marriage. It is further alleged that when the daughter of the informant shouted then the villagers tried to catch them but the accused persons successfully fled away. Accordingly, the FIR was lodged.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is also submitted that the date of occurrence is 15.02.2026 but the FIR was lodged on 18.02.2026, after a delay of three days from the date of occurrence.

5. It has further been submitted that the petitioner is having a love affair with the victim girl. The victim girl left her house with her own sweet will. It is submitted that the victim was not kidnapped by anyone and they have performed marriage on 16.02.2026 at Danapur, Patna.

6. Statement under Section 183 of the B.N.S.S. of the victim girl, Kumanti Kumari had been recorded in which the victim has said that she had left her house without any pressure and she had gone by her own sweet will. She has further stated in her statement that she was in love with the petitioner and she had married the petitioner at Danapur, Patna with her own will and not under any pressure and after marriage, both of them went to Mumbai. She had also stated that she did not want to

6. Learned counsel for the petitioner submits that the petitioner is in custody since 01.04.2026 and he is having one criminal antecedent in which he had been granted bail.

7. Learned counsel for the informant and learned A.P.P. for the State have vehemently opposed the prayer for bail.

8. Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, East Champaran, Motihari in connection with Pipra P.S Case No. 71 of 2026, subject to the condition that one of the bailors should be family member of the petitioner.
