The petitioner seeks bail in Kotwali P.S. Case No. 75/2019, instituted for offences under Section(s) 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. The instant case has been registered on the basis of C.C.T.V. footage. No T.I.P. has been held in this case. Petitioner has been made accused on the basis of seizure-list, which is part of F.I.R. It is mentioned in para 14 of bail petition that from the seizure-list and confessional statement it is evident that alleged recovery was made on 06.02.2019 at about 6:30 A.M. whereas petitioner was arrested at about 1:30 P.M. On the same day at

There is no identifying mark on the currency notes stolen from the Mall, as alleged in the written report. Petitioner is in custody since 07.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 75/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
