The petitioner, apprehending arrest in connection with allegation for offence under Sections 120B, 147, 148, 149, 307, 323, 337, 338, 341 and 302 of the Indian Penal Code, has come out with a defence that there is no eye witness to the occurrence and that the allegation against the petitioner, being an agent in the FIR filed by the widow/informant, has no basis. This Court has carefully perused the case diary and in its para no. 228, the investigating officer, while summarizing the gist of the investigation, has found implication of the petitioner along with other co-accused. That apart, the petitioner has a proven track record of criminal antecedent, as in fact is also admitted in para no. 3 of the bail application. Considering these aspect, this Court is not inclined to

Patna High Court Cr.Misc. No.24631 of 2015 (4) dt.02-09-2015 2/2 grant privilege of anticipatory bail to the petitioner. The prayer for anticipatory bail to the petitioner is hereby rejected.

The petitioner must surrender and thereafter his prayer for regular bail shall be considered on its own merit. (Mihir Kumar Jha, J) Sujit/- U
