Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 201, 366A, 504, 506, 34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the victim has performed marriage with the petitioner and she is aged about 20 years and an affidavit to that effect has been filed on behalf of the victim before learned Court below which has been brought on record as Annexure-2. Considering the present stand of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail

Patna High Court Cr.Misc. No.23749 of 2015 (2) dt.09-07-2015 2/2 for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Baunsi P.S. Case No. 25 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Let the petitioner produce the victim before learned Court below on 3rd of August, 2015 when learned Court below will record the statements of the victim and if the victim admits that she voluntarily married with the petitioner and she is found major then provisional anticipatory bail of the petitioner will be confirmed by learned Court below.
