This appeal is directed against the order dated 19.09.2020 passed by the learned 1st Addl. Sessions JudgeCum-Special Judge (SC/ST Act), Nawada in connection with Special Case No. 193 of 2018 arising out of Rajauli P.S. Case No. 288 of 2018, dated 22.10.2018, registered for the

Patna High Court CR. APP (SJ) No.2119 of 2020(2) dt.05-01-2021 2/3 offences under Sections 147, 341, 323, 447, 427, 379, 436, 504 and 506 of the Indian Penal Code and Sections 3(i)(r) and 3(ii)(iv) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989, whereby the prayer for grant of bail of the appellant has been rejected. From the perusal of the First Information Report, it appears that several persons have been made accused in this case including the appellant, but there is no specific accusation against him.

It has been submitted on behalf of the appellant that he has falsely been implicated in this case. He is a person of clean antecedent and one of the accused persons of this case has been granted bail by the Court below. The appellant is stated to be in custody since 10.09.2020.

Regard being had to the facts afore-stated, the order dated 19.09.2020, referred to above, is set-aside. The appellant, above-named, is directed to be released on bail on his furnishing bail bond in sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the
