JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Rupaulee (Mohanpur) P.S. Case No. 59 of 2015 for the offences instituted under Sections 302/34 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that the instant case has been registered against unknown person on the basis of fardbeyan of the son of the deceased. It is alleged that on 21.03.2015 at about 6.00 P.M. while the deceased, namely, Wakil Singh, alongwith another were returning to their home on motorcycle from Rupauli, the unknown miscreants committed murder by fire arms on account of which, Wakil Singh died at the spot and another person, namely, Md. Ishaque Mian died in the way, while he was

The miscreants fled away from the place of occurrence through maize field after leaving the motorcycle bearing Registration No. BR-19J/0177. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is not named in the F.I.R. His name has come in course of investigation on the basis of confessional statement of the co-accused. Except for that there is no other material to suggest the implication of the petitioner.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Rupaulee (Mohanpur) P.S. Case No. 59/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
