The petitioner seeks bail in connection with Barauni P.S. Case No.190 of 2016 registered under Sections 399, 402 and 414/34 of the Indian Penal Code besides Sections 25(1-b)a, 26 and 35 of the Arms Act, 1959.

The accusation is that the police, on receiving secret information about gathering of the some miscreants near Keshawe Hanuman Temple on parking the vehicle, reached there. On seeing the police party, the miscreants started to flee away but six miscreants including the petitioner were apprehended while some others succeeded in fleeing away. The apprehended miscreants

Patna High Court Cr.Misc. No.27544 of 2016 (3) dt.14-07-2016 2/3 disclosed their name as Santosh Tiwary alias Annu Tiwary, Abhimanyu Kumar, Chamru Singh (petitioner), Priyant Kumar, Amit Kumar and Arun Kumar. On search, Santosh Tiwary alias Annu Tiwary and Abhimanyu Kumar were found in possession of one loaded country made pistol and one cartridge whereas the petitioner, Priyant Kumar, Amit Kumar and Arun Kumar were found in possession of mobile sets.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case on mere suspicion. Further submission is that while the petitioner is accused in three other cases, as detailed in paragraph-3 to this application, but in that cases, the petitioner is on bail. The petitioner, in the present case, is in custody since 12.05.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No.190 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
