NILU AGRAWAL ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner and learned A.P.P. The petitioner apprehends his arrest in Jamui P.S. Case No. 260/2010 instituted for offences punishable under Sections 364,302,201, 120B/34 of Indian Penal Code.

The prosecution case is that on 23.9.2010 at about 1.00 P.M., the informant's brother Umesh Yadav had gone to Jamui Bazar for selling milk but he did not return till date. On 25.09.2010 the dead body was found alongwith chappal, pant, gamachha and key of box near Eastern side of village- Pratappur near bank of river.

Although, that the F.I.R. is against unknown persons but at paras-56 and 57 of the case diary, names of Manjay Yadav, Shaligram Yadav and Rajaram Yadav, figures.

As per para-63 of the case diary, there is allegation of

Patna High Court Cr.Misc. No.2006 of 2015 (3) dt.13-05-2015 2/2 hatching conspiracy against the petitioner, who was during the time of occurrence not in the village but was at Deogarh. There are no sufficient materials to suggest specific allegation against the petitioner.

Under such circumstances, it is directed that in the event of arrest of surrender within a period of four weeks from today, the above named petitioner Bharat Yadav shall be released on bail on furnishing bail bonds of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in Jamui P. S. Case No. 260/2010, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
