The petitioner seeks bail in a case instituted under Sections 419 and 420 of the Indian Penal Code and Section 10 of Bihar Examination Act.

The allegation against the petitioner is that he has appeared in Assistant Examination in stead of one Anil Kumar. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.05.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of examination alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner has already

Patna High Court Cr.Misc. No.31196 of 2016 (3) dt.26-09-2016 2/2 remained in custody for approximately four months. On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif (Nalanda), in connection with Bihar P.S. Case No. 214 of 2016.
