ANJANA MISHRA ORAL ORDER 21-06-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 12.05.2019 in connection with Rail Gaya P.S. Case No. 190 of 2019 registered for the offence under Sections 30 (a) & 30 (d) of the Bihar Prohibition of Excise Act, 2018.

Learned counsel for the petitioners submits that the alleged recoveries were, from train compartment in which the petitioners were also travelling with other co-passengers and not from the conscious possession of the petitioners. It has further been submitted that the petitioners have no criminal antecedents.

Considering the aforementioned facts and
