Two counter affidavits one on behalf of respondent nos. 4,6 and 8 and another on behalf of the respondent no.5 have been filed.
The petitioner prayed for a legal action including recovery of salary against the respondent no.9 who served as chowkidar suppressing his actual date of birth. In the counter affidavit , the respondents have stated that acting on his complaint
Patna High Court CWJC No.20371 of 2011 (2) dt.28-09-2015 2/2 action has already been taken insomuch so, respondent no.9 has been made to retire from service treating his year of birth as 1950. Since he had worked in excess by two months, the salary paid for these months have also been recovered. The writ application, in that view of the matter, has become infructuous.
