The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 23.12.2019 at 2:00 AM in the night, some unknown thieves stole his Mahendra tractor with trolley as detailed in the FIR.

Learned counsel for the petitioner submits that the FIR was against unknown and the name of the petitioner transpired during the course of investigation in the confessional

Patna High Court CR. MISC. No.49732 of 2021(2) dt.08-08-2022 2/2 statement of co-accused Ajay Yadav which has no evidentiary value, it is next submitted that even the alleged tractor has been recovered from the possession of Ajay Yadav.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Akorhigola P.S. Case No. 05 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
