JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report and from perusal of the impugned order it would appear that looted motorcycle has been recovered from conscious possession of co-accused, Vikash Kumar, who disclosed the name of the petitioner as his associate. Moreover, petitioner is in jail custody since 11.03.2016 and it appears that except the above stated disclosure of co-accused, Vikash Kumar and some criminal antecedent of the petitioner, there is nothing against him. Considering the aforesaid facts and circumstances as

No.30665 of 2016 (2) dt.08-08-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 458 of 2015.
