Pursuant to order dated 04.12.2015, 3rd supplementary counter affidavit has been filed on behalf of respondent no. 2 in which it has been stated that remaining 10% of pension and full gratuity which had been kept in abeyance has now been ordered to be released.

In view of the aforesaid, the writ petition stands disposed off.

However, since the departmental proceeding against the petitioner is still pending, the Court is not in a position to finally take a view as to whether the interest should be paid to the petitioner. Accordingly, the issue of interest is kept open and in case the petitioner is discharged in the departmental

Patna High Court CWJC No.18551 of 2011 dt.04-01-2016 2/2 proceeding she will be at liberty to move before the authority for payment of interest on delayed payment.
