The petitioner is apprehending his arrest in a case registered under sections 448, 341, 323, 324, 308, 379, 504 and 506/34 of the Indian Penal Code.

According to the first information report the petitioner assaulted the husband of the informant by bamboo on his head.

It is submitted on behalf of the petitioner that petitioner has no criminal antecedent. It is further submitted that petitioner has been falsely implicated due to village politics. From perusal of the injury report it appears that the injury is superficial in nature.

Patna High Court Cr.Misc. No.23640 of 2015 (3) dt.03-09-2015 2/2 On behalf of the State it is submitted that there is direct allegation against the petitioner of assaulting the husband of the informant on the head with lalthi.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected. However, if the petitioner surrenders before the court below in connection with Rajapakar P.S. Case No. 112/2014 within a period of four weeks from the date of receipt /production of a copy of this order, the court below shall consider the case of the petitioner on its own merit without being prejudice by the order of this court. The application may be disposed of on the same day if possible.
