Petitioners seek bail in connection with Akorhigola P.S. Case No. 125 of 2016 registered for the offences punishable under Sections-414, 34 of the Indian Penal Code. Allegedly, the petitioners were apprehended when they were fleeing away after leaving tractor and motorcycle and regarding the tractor, both stated that it was brought from Aurangabad after stealing.
Submission is of false implication and that there is no report regarding theft of the said tractor. The motorcycle is of brother of the petitioner No. 2 Ranjay Kumar. Without any cogent
Patna High Court Cr.Misc. No.3487 of 2017 (2) dt.27-02-2017 2/2 and legal material, the petitioners are suffering in custody since 01-12-2016 and now, by remaining in custody, they have been sufficiently penalized.
The learned APP opposes the prayer of bail.
Considering the period of detention of the petitioners in jail custody, both the petitioners named above, are directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Akorhigola P.S. Case No. 125 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, DehriOn-Sone, Rohtas. (Jitendra Mohan Sharma, J) A.K.V./- U T
