24-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Chiraiya P.S. Case No. 294 of 2020, registered for the offence under Sections 356 & 379 of the Indian Penal Code.

As per F.I.R., three miscreants riding on a motorcycle intercepted the informant, got him down from the motorcycle and fled away after snatching his motorcycle alongwith bag of the informant containing cash of Rs. 1,52,971/- and other articles.

Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation on the basis of confessional statement of co-accused Radhe Shyam Kumar. It is further submitted that no incriminating article has been recovered from the possession of the petitioner. Till date,

Patna High Court CR. MISC. No.49765 of 2021(2) dt.24-11-2021 2/2 petitioner has not been put on T.I.P. and petitioner is in custody since 11.02.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Shikrahna, Dhaka, East Champaran, Motihari in connection with Chiraiya P.S. Case No. 294 of 2020.
