Petitioner is in custody since 10.12.2016 in connection with Forbesganj P.S. Case No. 655 of 2016 registered under Sections 380 and later on 411 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. but during investigation this petitioner has been arrested by the Police merely on suspicion and Rs. 2200/- has been recovered from the possession of the petitioner. Except this nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner, who is of clean antecedent, is rotting in custody for the last two months. Moreover, co-accused, Tabrez @ Md. Tabrez has already been granted bail by co- ordinate Bench of this Court in Cr. Misc. No. 10220 of 2017.
Patna High Court Cr.Misc.
