The petitioner seeks bail in connection with Bochahan P.S. Case No. 307 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code.
The case of the prosecution, in short, is that the informant, namely, Pankaj Kumar Pandey, Branch Manager of Utkarsh Small Finance Bank at Sarfuddinpur Branch has stated in his written information that on 29.08.2019 in the evening hour, he along with other staff was in branch and in the meantime, six unknown miscreants came and looted away cash of Rs.3,95,371/- on the point f gun. It is further alleged that miscreants committed assault with the staff and damaged the computer set.
Patna High Court CR. MISC. No.37393 of 2020(3) dt.02-03-2021 2/2 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that the petitioner is not named in the F.I.R. in the present case. On the basis of confessional statement of the co-accused, the petitioner has been made accused in the present case. He further submits that till date, no T.I.P. has been conducted. There is no recovery of any incriminating article from possession of the petitioner. Petitioner is in jail custody since 28.02.2020.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-14th, Muzaffarpur in connection with Bochahan P.S.
