JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-04-2018 The present petition is directed against the order dated 12.11.2014 passed by the learned Sub-Divisional Judicial Magistrate, Patna in connection with Complaint Case No. 1044 (C) of 2010 whereby the prayer made on behalf of the petitioner for being discharged of the offences under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act, has been rejected.
The learned counsel appearing for the O.P. No. 2 has submitted that after framing of the charge, the complainant has also been examined. That apart, till date, no settlement has been arrived at between the spouses.
Patna High Court Cr.Misc. No.47202 of 2014 (5) dt.10-04-2018 2/2 There is no reason for this Court to interfere with the trial at this stage.
However, it is made clear that during the trial, if the parties effect a settlement, the same shall be looked into by the Trial Court and necessary orders shall be passed thereafter.
With the aforesaid observation, the present petition is disposed of.
