The petitioner apprehends his arrest in connection with Pipra P.S. Case No. 51 of 2018, registered under Sections 414 and 413/34 of the Indian Penal Code.

The accusation is that on receiving secret information about committing theft of motorcycle and selling the same in neighbouring district by Chandan Paswan with the help of four persons named in the F.I.R. including the petitioner, the informant along with other police personnel reached at the house of Chandan Paswan, who disclosed about the involvement of several persons in committing theft of motorcycle and four wheeler and on disclosure of Chandan

Patna High Court CR. MISC. No.43045 of 2019(3) dt.19-08-2019 2/2 Paswan, one motorcycle was recovered from the house of Chhotu @ Subhash Yadav and this petitioner succeeded to flee away with the stolen motorcycle.

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot rather his name has been disclosed by one co-accused, Chhotu @ Subhash Yadav and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Supaul, in connection with Pipra P.S. Case No. 51 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
