2. The petitioner has preferred this application for grant of regular bail in connection with Ara Town P.S. Case No. 129 of 2024 dated 17.02.2024 registered for the offence/s punishable u/ss 323, 341, 307 of the Indian Penal Code.
3. As per the prosecution case, 3-4 unknown miscreants came near the informant and one miscreants slapped the informant. On being objected, another miscreant inflicted blow of knife which hit below his stomach.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of
Patna High Court CR. MISC. No.42192 of 2024(2) dt.24-06-2024 2/2 the petitioner has sprung up on mere suspicion. No TIP has been conducted by the prosecution. It is further submitted that the impugned order dated 09.05.2024 does not show the nature of injury. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 14.04.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and stated that the informant sustained knife blow just below umbilical cord measuring 2cmx2cm.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Ara Town P.S. Case No. 129 of 2024.
7. The application stands allowed.
