JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is languishing in jail since 19.05.2016 in a case registered for the offences punishable under Sections 21(a)(b) and 22(a)(b) of the N.D.P.S. Act.
From the hutment of the petitioner, 350 gram of ganja, 24 packets of cigarette filled with ganja weighing 200 gram, total weigh 550 gram total weighing 550 gram one Nokia Mobile and Rs. 700/- cash were recovered.
It is submitted by learned counsel for the petitioner that admittedly recovery has been made from the hutment where none was found residing. Moreover, total quantity of recovery is of 550 gram which includes tobacco of the cigarette, also hence recovery is of small quantity. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.30997 of 2016 (2) dt.27-07-2016 2/2 Learned A.P.P., Mr. J.N Thakur does not dispute the small quantity of recovery.
Considering the quantity of recovery and statement made in para 3 of the petition that the petitioner has no criminal antecedent let the petitioner be released on bail on furnishing bail bond of Rs. 10,000(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge cum Special Judge (NDPS) Act, Darbhanga in connection with Bahadurpur P.S. Case No. 195 of 2016.
