JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-04-2021 Heard Mr. Ravindra Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Ara Nawada P.S. Case No. 1012 of 2019, dated 28.11.2019, instituted for the offences under Sections 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The accused persons including the petitioner are
Patna High Court CR. MISC. No.36859 of 2020(2) dt.07-04-2021 2/3 said to have opened fire at the house of the informant, but nobody appears to have been hurt. The evidence of firing resorted to by the accused persons is by way of producing empty cartridges to the police.
The learned counsel for the petitioner has submitted that the present accusation is only for the purposes of pressurising the petitioner and others for compounding the case vide Ara Nawada P.S. Case No. 1004 of 2019, which has been lodged by one of the relatives of the petitioner, viz., Amit Kumar Paswan.
Considering the fact that nobody has been injured in the occurrence and there is general accusation of resorting to firing as well as the background facts, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 1012 of 2019, subject to
Patna High Court CR. MISC. No.36859 of 2020(2) dt.07-04-2021 3/3 the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
