JUSTICE SANJAY PRIYA ORAL ORDER 06-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sonepur P.S. Case No. 479 of 2016 instituted for the offence under Sections-307, 326(A), 427 & other minor sections of the Indian Penal Code. The allegation against the petitioner is that he abused the police party when he went to arrest the petitioner in connection with another case. It is also alleged that he threw acid on the trousers of one of the raiding party and also attempted to assault the informant.
The C.D. has been received.
Learned A.P.P. referring the injury report which is in paragraph-26 of the C.D. submits that the doctor has found swelling, bruise on the person of the injured. The nature of injury
Patna High Court Cr.Misc. No.8096 of 2017 (3) dt.06-04-2017 2/2 is simple in nature caused by hard and blunt substance. The police prepared seizure list which shows that two bottles of acid and a Kudal were seized from possession of the petitioner. There is no mention that any cloth of the police officer was burnt on account of throwing of acid. The seizure list also does not show that any burn injury on the cloth of the police party was found. Considering the above-said facts and circumstances of the case as well as submission of the parties, this petition is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sonepur P.S. Case No. 479 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Saran subject to condition that both the bailors should be close relative of the petitioner who will swear an affidavit as to how they are related with the petitioner.
