The petitioner seeks bail in Sanokhar P.S. Case No. 101 of 2021, registered for the offence punishable punishable under Section 30(a), 32(2),(g) of the Bihar Prohibition and Excise Act, 2016.

190.5 litres of foreign liquor has been recovered from a bus of which this petitioner is one of the occupants. It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and he was simply a copassenger. Petitioner is in custody since 28.06.2021. Investigation is complete.

Considering the period of custody, the petitioner

Patna High Court CR. MISC. No.49768 of 2021(2) dt.25-11-2021 2/2 above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IInd-cum-Special Judge (Excise Act), Bhagalpur in connection with Sanokhar (Amdanda) P.S. Case No. 101 of 2021.
