The petitioner seeks bail in Khagaul P.S. Case No. 31 of 2016, registered for the offences punishable under Section 376 and other Sections of the Indian Penal Code.
The victim alleged that the petitioner who happens to be son of her maternal uncle came to her house and established physical relation with her since the year 2013 to the end of year 2015, but later on the petitioner refused to marry with the victim. Learned counsel for the petitioner submits that the victim is a major girl and the petitioner and the victim have already solemnized marriage. Notice was issued to the victim. The victim is also present.
Patna High Court Cr.Misc. No.31880 of 2016 (3) dt.08-11-2016 2/2 Learned Additional P.P., however, opposed the prayer for bail.
Considering the nature of allegations made against the petitioner, it appears that the victim was a consenting party and the petitioner is in jail since 03.03.2016, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Raghvendra Narayan Singh, Judicial Magistrate 1st Class, Danapur in connection with Khagaul P.S. Case No. 31 of 2016.
