JUSTICE RAKESH KUMAR ORAL ORDER 17-08-2016 Learned counsel for the petitioner tried to persuade the Court to examine the case on merit, whereas, fact remains that earlier thrice, the prayer for bail has already been rejected. Accordingly, there is no reason to examine the case on merit. Once the prayer for bail was rejected on merit, subsequently, there is no point to argue on merit. The bail petition can be considered only in changed circumstances. On being asked regarding the stage of the case, learned counsel for the petitioner, in presence of Sri Ganesh Prasad Singh, learned Addl. Public Prosecutor, submits that in the case, evidence is going on.
Since the trial is going on, there is no point to review my earlier order.
