JUSTICE BIRENDRA KUMAR ORAL ORDER 25-06-2018 Perused the supplementary affidavit filed on behalf of the petitioner disclosing his criminal antecedents, which are subsequent to the present case or the petitioner had no knowledge of one of the cases till filing of this bail application. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft is against unknown.
Submission is that nothing was recovered from the possession of the petitioner; rather a motorcycle was recovered from Gate No.1 of Civil Court, Purnea, and the petitioner was
Patna High Court Cr.Misc. No.16218 of 2018 (4) dt.25-06-2018 P2/ arrested in that case on suspicion.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chousa P.S. Case No.156 of 2017, with condition that both the bailors shall be the residents of territorial jurisdiction of the Court-below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
