This is an application for bail in connection with Sugauli P.S.Case No. 4 of 2017 for the offences punishable under Section 30(a) of the Bihar Excise and Prohibition Act. It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent and remained in custody for two months and nothing has been recovered from the possession of the petitioner, rather there is alleged recovery of 120 bottles of foreign liquor containing 750 ml. in each bottle from Scorpio vehicle and from Tempu 225 bottles of foreign liquor containing 180 ml in each bottle have been recovered on which several persons were traveling and out of five persons three were arrested, including the petitioner.

Having heard both sides and in view of the allegation as stated above, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail before the court below after three months and the court below will consider the period of detention as well as antecedent of the petitioner and pass appropriate order.
