JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-489(A), 489(B), 489(C ) of the Indian Penal Code. Co- accused, Sanjay Sah was arrested with counterfeit notes and the aforesaid Sanjay Sah disclosed the name of petitioner, levelling allegation against him that the seized counterfeit notes were given to him by this petitioner. From perusal of the impugned order, I find that except the aforesaid material, there appears to be nothing against the petitioner who does not have any criminal antecedent. Moreover, co-accused Sanjay Sah has already been granted
Patna High Court Cr.Misc. No.35432 of 2016 (3) dt.30-08-2016 2/2 privilege of bail by this court.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kotwa P.S. Case No. 60 of 2016 to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari.
