The petitioner seeks bail in Gaya Muffasil P.S. case No. 551 of 2016 under Section 272, 274, 275, 420, 120B of the Indian Penal Code and under Section 33EEB, 33EEC and 33E of Drugs and Cosmetics Act.
The police arrested one Muhammad Ali and he is said to have disclosed that petitioner was preparing Ayurvedic medicines in the house of Randhir Singh. On such, raid was conducted and the petitioner was found preparing different Ayurvedic medicines.
The learned counsel for the petitioner submits that petitioner is a labourer and he was only mixing different medicines at the instance of Muhammad Ali, who is owner of
Patna High Court Cr.Misc. No.14070 of 2017 (2) dt.13-04-2017 2/2 Chanda Ayurvedic Pharmacy. It is submitted that no spurious medicine was found. The petitioner is in jail since 28.12.2016. Considering the facts that petitioner is a labourer and he was preparing Ayurvedic medicines under the instruction of Muhammad Ali, the owner of Chanda Ayurvedi Pharmacy, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Gaya Muffasil P.S. Case No. 551 of 2016.
