JUSTICE BIRENDRA KUMAR ORAL ORDER 15-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.
According to FIR, wife of this petitioner committed suicide on 02.01.2008. For the aforesaid occurrence UD Case No.1 of 2008 dated 02.01.2008 was registered on the statement of the brother of the deceased. Thereafter, the present case was lodged on 11.01.2008 with allegation that in fact the deceased was married with the petitioner on 26.05.2002 and thereafter there was demand of dowry and torture for the same and the death was in fact due to non-fulfillment of dowry demand.
Patna High Court Cr.Misc. No.15906 of 2018 (3) dt.15-05-2018 P2/ Submission is that the petitioner is in custody since 30.08.2017. Some of the witnesses have stated before the police that in fact maternal relation of the deceased had participated in the cremation of the deceased and the death was suicidal one.
Considering the nature of material available, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kudhani P.S. Case No.22 of 2008, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
