Petitioner seeks bail in a case registered under sections 385, 387 and 504 of the Indian Penal Code.

Informant got demand for extortion money from a mobile phone. The caller of the aforesaid mobile disclosed his name as Dhiran Yadav.

In course of investigation, location of the aforesaid mobile at the time of alleged occurrence was found Chanakya Nagar, Begusarai.

Admittedly, petitioner was in jail custody at the time of alleged occurrence and it appears from perusal of the impugned order that learned Sessions Judge rejected the bail prayer of the petitioner on the ground that location of the aforesaid mobile at the relevant time was found near jail. Moreover, I.O. failed to collect the name of

. No doubt, petitioner carries criminal antecedent of several cases but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Begusarai Mufassil P.S.
