JUSTICE SUDHIR SINGH ORAL ORDER 14-05-2015 The petitioners are apprehending their arrest in connection with Tekari P.S.Case no. 285 of 2014 instituted under Sections 147, 149, 341, 448, 323, 325, 307 and 504 of the Indian Penal Code.
Heard learned counsel for the petitioners and the State. It is alleged in the fardbeyan of one Gopal Saw that on 16.09.2014 at about 7 o' clock female members of his family and other women had gone for natural call , at that time some boys of Pandey Bigha used some filthy language with them, thereafter
Patna High Court Cr.Misc. No.1006 of 2015 (3) dt.14-05-2015 2/3 villagers sent them in the night. On 17.9.2014 when he was washing his hand in front of his house, at that time named accused persons along with 10-15 unknown persons came with lathi and stick and started abusing and assaulting him. He raised hull then Niwash Saw, Lallan Saw, Vidyanand Saw and Sanjay Kumar came for rescue then they were also assaulted by the accused -persons. They received several injuries. It has been submitted on behalf of the petitioners that the alleged occurrence is said to have taken place due to irrigation of field. Further it has been submitted that omnibus and general allegation has been made against the petitioners. It is further submitted that no specific injury has been attributed against the petitioners.
On behalf of the State, it has been submitted that injuries sustained by the informant's side are simple in nature except one injury sustained by Gopal Saw, which is said to be grievious caused by hard blunt and substance. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri
