This is an application for bail in connection with Majorganj P.S.Case No. 20 of 2016 registered for the offences punishable under Sections 387 of the Indian Penal Code and Sections 25(1b)a, 26 & 35 of the Arms Act.

Submission of learned counsel for the petitioner is that there is alleged recovery of one country made pistol and one cartridge but petitioner has remained in custody for about one year. It has been further submitted that though petitioner has been made accused in other cases but in those cases he is on bail. Heard learned APP also, who has opposed the prayer for bail stating that petitioner has been caught at the spot and one country made pistol has been recovered from his possession.

No.6953 of 2017 (2) dt.17-02-2017 2/2 Having heard both sides and in view of the fact that petitioner has been arrested at the spot and country made pistol has been recovered, coupled with the fact that petitioner has been made accused in three other cases, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after framing of charge in this case. With the above observations, this application is dismissed.
