The petitioner is languishing in custody since 04.06.2016 in connection with Kurtha P.S. Case No. 24 of 2014 for the offences instituted under Section 395 of the IPC. The prosecution story, in brief, is that on 10.02.2014 at about 2.30 P.M., while the informant was making accountancy of money with the dealers in his Kerosene Oil Depot, five unknown miscreants had looted away Rs. 1,50,000/- on the point of pistol from the Kerosene Oil Depot of the informant Lakshmi Narayan Gupta. Accordingly, the F.I.R. was instituted. It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.06.2016 and the charge sheet has
Patna High Court Cr.Misc. No.31793 of 2016 (5) dt.17-09-2016 2/2 been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He is not named in the F.I.R. In paragraph no.3 of the case diary, the petitioner is being suspected to be involved in the present case. He has not been put on T. I. Parade. There is no recovery of any incriminating article from possession of the petitioner. The other co-accused have been granted bail by another co-ordinate Bench of this Court vide Annexure-2 to the present application. On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Arwal (Jehanabad) in connection with Kurtha P.S.
