The petitioner is accused in connection with Sonepur P.S. Case No. 279 of 2016, registered under Sections 304(B) and 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act, pending in the court of Additional Sessions Judge-XI, Saran at Chapra.

The accusation is of killing the daughter of informant by her husband and in-laws due to non-fulfillment of demand of dowry and to dispose of her dead body.

Learned counsel for the petitioner submits petitioner, who is the husband of the deceased, has falsely been implicated. In fact, deceased, daughter of informant, died due to diarrhoea and

Patna High Court Cr.Misc. No.17569 of 2017 (2) dt.03-05-2017 the information was also given to the informant to participate in the funeral rites but with ulterior motive the present case has been lodged with false allegation. Further submission is that petitioner is in custody since 06.08.2016.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
