JUSTICE MADHURESH PRASAD ORAL ORDER 22-05-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are accused in a case registered for offence under sections 302, 201/34 IPC.

Petitioners claim parity with co-accused Yogendra Bin who has already been allowed bail by this Court vide order dated 28.2.2018, passed in Cr. Misc. No. 2515 of 2018. Learned counsel for the petitioners submits that no specific allegation has been levelled against the petitioners and they have been implicated in this case on suspicion. Prior to the lodging of this case, they are not accused in other case. Petitioner nos. 1 and 2 are in custody since 30.10.2017, whereas petitioner no. 3 is in custody since 23.12.2017.

Let all the three petitioners above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha (West Champaran) in Piprasi Police Station Case No. 22 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners.

(b) They will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
