The petitioner seeks bail in Forbesganj P.S. Case No. 100/2017, registered for the offences punishable under Section 30 Bihar Prohibition & Excise Act.

The police apprehended two persons namely, Sukdeo Rai and Manish Kumar. From their possession 90 bottles and 80 bottles respectively containing Nepali liquor were recovered. The apprehended accused disclosed the name of the petitioner and others, thereafter, the police also recovered 780 bottles. Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and nothing has been recovered from his possession. The petitioner is in jail since 22.02.2017.

Patna High Court Cr.Misc. No.18818 of 2017 (2) dt.26-04-2017 Considering the facts aforesaid and the fact that petitioner has remained in jail for more than two months for the recovery of Nepali liquor, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 100/2017.
