The petitioner apprehends her arrest in Muzaffarpur Sadar P.S. Case No.900 of 2018 registered under Sections 406, 420, 506 and 34 of the Indian Penal Code.

The informant filed complaint petition on the basis of which the present F.I.R. was lodged. In sum and substance, the informant alleged that Sandeep Kumar along with other accused persons came to her house and expressed deep sorrow and grief on account of death of her father. The accused persons persuaded the informant and her mother to invest in business so that they would get good return from such investment. On such assurance made by the accused persons, the mother of the informant gave Rs.30 lacs to Sandeep Kumar (accused no.1) but

No.37959 of 2019(2) dt.21-06-2019 2/3 the accused persons committed criminal breach of trust and did not either pay the principal amount or the profit of the investment made by the mother of the informant. Learned counsel for the petitioner submits that the petitioner is the wife of Sandeep Kumar (accused no.1). The mother of the informant did not give any money to the petitioner for investment in business. Similarly situated co-accused, against whom there is allegation of giving assurance of good return, have already been granted anticipatory bail by this court vide order dated 10.05.2019 passed in Cr.Misc.No.31291 of 2019.

Having considered the facts that there is allegation against the petitioner that the petitioner gave assurance to the informant and her mother for investment in business so that they would get good return but the informant and her mother did not hand over money to the petitioner, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with
