The petitioner is accused in connection with Patahi Pachpakri P.S. Case No. 135 of 2016 registered under Section 394 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the First Information Report and during the course of investigation, the name of the petitioner has surfaced on the basis of confessional statement of one Junglee Baitha and on his statement, the looted motor-cycle is said to have been recovered. Patna High Court Cr.Misc. No.20963 of 2017 (2) dt.12-05-2017 2/2 apprehended by the Police on 17.11.2016 in connection with Patahi P.S. Case No. 154 of 2016, was remanded in the present case on 31.01.2017 and since then he is in custody. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate,-VIII, East Champaran, Motihari in connection with Patahi Pachpakri P.S. Case No. 135 of 2016, subject to the condition that out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Mahesh/- U T
