Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 307, 302 and 324/120B of the Indian Penal Code.

Though allegation against the petitioner is of commission of assault at the head of the deceased with farsa. However, during trial, informant stated that the petitioner was not present at the time of occurrence. Other three prosecution witnesses have also turned hostile. Considering the fate of the trial, let the petitioner, above named, who is in custody since 10.08.2015, be released

Patna High Court CR. MISC. No.36061 of 2019(2) dt.04-06-2019 2/2 on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 223 of 2018 arising out of Lalganj Police Station Case No. 217 of 2015, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
