ANJANA MISHRA ORAL ORDER 08-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 07.11.2017 in connection with Danapur P.S. Case No. 718 of 2017, registered for the offence under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that though the allegation is being made against the petitioner under Section 302 of the IPC and Section 27 of the Arms Act but charge has been submitted under Section 304 of the IPC and Section 27 of the Arms Act.

Diary in the present case was called for, which has since been received, wherein, there is no further cogent material to support the case of the prosecution.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.21002 of 2018(2) dt.08-05-2018 2/2 circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Danapur, Patna, in connection with Danapur P.S. Case No. 718 of 2017.
