JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of petitioner came in this case in confessional statement of co-accused and it appears from the pleadings of the petitioner that except criminal antecedent as well as confessional statement of co-accused, there is nothing against him. Petitioner is in jail custody since 03.03.2016 and his prayer for bail was rejected by the learned Sessions Judge, Aurangabad, on 15.06.2016 but it appears that at the time of rejection of prayer for bail of the petitioner, the investigation against the petitioner was pending.

Learned counsel for the petitioner points out that investigation against the petitioner has already been completed

Patna High Court Cr.Misc. No.28887 of 2016 (2) dt.25-07-2016 2/2 and charge sheet has been submitted against him. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Aurangabad in connection with Uphara P.S.Case No. 44 of 2014.
